To my constituents in Allenstown, Epsom, and Pittsfield:
This year I’m submitting 17 bills, nearly all from constituent
requests or from the study committees I served on this summer. The
two most important bills eliminate some old exemptions from rule
making procedures, and put a number of license fees into statute
(reducing nearly all of them). That came from the committee on fees
in rules, where we found that the smaller licensing boards didn’t
have the budgetary flexibility to limit their fees to their expenses
– and they didn’t want to repeatedly adjust their fees. The
exemptions came to light when we were investigating a constituent’s
problem getting a state driveway permit, and found that the state
was using lot definitions from 1971 to determine how many driveways
were allowed! The Department of Transportation could do this because
they were exempted from rule making oversight: they could make any
rules they wanted for driveway permits, with no public hearings, no
expiration dates, and no oversight. I found several other exemptions
of the same sort – mostly more than 30 years old – and plan to
repeal them.
Two more significant bills came from the committee investigating the
state Liquor Commission: one to revise their rule making authority
to be more specific and narrower, and another to expand the ability
of restaurants and specialty shops to buy wine and spirits from
sources other than the liquor commission. Right now they need the
commission’s permission to buy any, which limits the variety of
wines available to consumers in the state. I’m working with the
commission on a procedure to authorize licensees to freely obtain
specialty wines and liquors without affecting the revenue the
commission brings to the state.

than fit here.
